Mediation Fees and Conditions

1.  Fee Schedule. The fee per party per day is £850 for claims up to £25,000. For claims for £25,000 - £100,000 the fee is £1,250 per party per day. Fees are negotiable for claims in excess of £100,000 or where the value of the claim is difficult to assess in financial terms, by agreement between parties and Disputes Resolved and where more than two parties are involved.  Disputes Resolved reserve the right to adjust fees if the dispute proves to be different from their initial expectation.

2.  The above rates include preliminary advice and assistance, convening a meeting, collecting and exchanging case summaries and documents and providing appropriate documentation.  Should, in the opinion of Disputes Resolved, exceptional administration be necessary the parties will be advised in advance of the cost.

3.  Mediator's preparation time as and when necessary will be charged by the hour at rates to be agreed in advance by Disputes Resolved with the parties and the mediator.  The parties to be advised in advance of the time required which will not, without further agreement of the parties, exceed six hours.  The cost to be shared equally between the parties.

4.  Expenses.  Travelling costs and disbursements incurred by the mediator charged at a sum advised by Disputes Resolved when convening the meeting.

5.  Payment.  The cost of the mediation fee, preparation time and expenses etc. as known at the time to be advised by Disputes Resolved in advance and paid two weeks before the date of meeting.  Further fees, for meeting time in excess of that originally anticipated or other reasonable disbursements, to be paid within 14 days of submission of invoice.  Payment of £300 for convening, being part of the total fee, to be paid by each party when the parties agree to mediate. Please note that late payment of fees may result in a postponement of a meeting date.

6.  Cancellation.  In the event of cancellation by any party:-

(i) at least 7 days before a mediation meeting (whether arranged or not) each party shall pay to Disputes Resolved a cancellation fee of £300.

(ii) 7 days or less before an arranged mediation meeting each party shall pay the prescribed mediation fee agreed with Disputes Resolved or if none agreed as set out in the Fee Schedule above.

Cancellation may arise:-

(a) by notice given by any or all parties to Disputes Resolved to this effect.

(b) By the failure of a party to proceed in the mediation process after Disputes Resolved have enquired of them whether they intend to do so ("an Enquiry").

Payment of the appropriate cancellation fee shall be made:-

(i) under sub-paragraph (a) above on giving the notice of cancellation and by other party/ies within 7 days of receiving notice of the cancellation from Disputes Resolved.

(ii) Within 7 days of receipt of an Enquiry by any party who shall fail to respond to the effect that they wish to proceed in the mediation process and by the other party/ies within 7 days of receipt of notice from Disputes Resolved requesting payment of the cancellation fee as a result of the deemed cancellation.

Any notice or Enquiry may be given or made by e-mail or post.

7.  Meeting Room.  The provision of accommodation for the meeting is the responsibility of the parties and provided free of cost to Disputes Resolved.  A room sufficiently large to accommodate meetings of all concerned and a room for each party for private meetings of parties with the mediator.  Appropriate toilet and refreshment facilities.
